GLOBAL TERMS OF SERVICE & STORE POLICY

Welcome to Raccoon Roses.

These Terms of Service & Store Policy ("Terms") apply to purchases made through the Raccoon Roses online store by customers worldwide.

By accessing our store or placing an order, you agree to these Terms. Nothing in these Terms removes consumer rights that cannot legally be waived in the customer's country or region.

1. About Raccoon Roses

Raccoon Roses is an independent motorcycle, motocross, street-riding and lifestyle-inspired merchandise brand.

Products may include:

  • Clothing and hoodies

  • T-shirts

  • Motocross-inspired jerseys

  • Accessories

  • Bags and luggage

  • Stickers

  • Gifts

  • Custom merchandise

  • Print-on-demand merchandise

  • Other Raccoon Roses branded products

Products available may vary depending on the customer's location.

2. Worldwide Orders

Raccoon Roses may accept orders from customers in multiple countries and regions.

Product availability, shipping methods, pricing, taxes and delivery times may vary by destination.

The ability to place an order does not guarantee that every product can be legally or practically delivered to every location.

We reserve the right to cancel an order if we or one of our fulfillment partners cannot reasonably deliver the product to the destination provided.

If an order is cancelled after successful payment, the affected amount will be refunded.

3. Product Information

We make reasonable efforts to ensure product photographs, descriptions, colors, measurements and other information are accurate.

However, slight variations may occur.

Colors can appear differently depending on:

  • Screen settings;

  • Lighting;

  • Manufacturing;

  • Printing method;

  • Materials; and

  • Individual production batches.

For made-to-order or printed merchandise, minor variations between products may occur and are not necessarily manufacturing defects.

4. Made-to-Order & Print-on-Demand Products

Some Raccoon Roses merchandise may be produced only after an order has been placed.

These products may require additional production time before shipping.

Customized or clearly personalized products may not qualify for cancellation or return rights in certain jurisdictions.

This does not remove any mandatory rights relating to defective, damaged, incorrect or non-conforming products.

5. Prices & Currency

Product prices will be displayed through our store.

Depending on your location, prices may be displayed or converted into your local currency.

Currency conversions may be approximate and may change according to exchange rates or payment providers.

Your bank, card issuer or payment provider may charge additional currency-conversion or international transaction fees. Such third-party fees are outside the control of Raccoon Roses.

6. Taxes, VAT, Customs & Import Charges

International orders may be subject to VAT, sales tax, GST, customs duties, import fees, brokerage charges or similar government charges.

Where these amounts are collected during checkout, this should be indicated through the store.

Where they are not collected during checkout, the customer may be required to pay them upon or before delivery.

The exact treatment depends on the destination country and applicable law.

Raccoon Roses cannot control charges imposed directly by customs authorities, governments, couriers or other third parties.

7. Payments

Available payment methods are displayed during checkout and may vary depending on the customer's country.

Orders will normally not enter production or fulfillment until payment has been successfully processed.

Raccoon Roses reserves the right to cancel or hold orders involving suspected:

  • Fraud;

  • Unauthorized payments;

  • Payment disputes;

  • Incorrect payment information; or

  • Other suspicious activity.

8. Order Information

Customers are responsible for providing accurate information when placing an order, including their:

  • Name;

  • Email address;

  • Shipping address;

  • Postal/ZIP code;

  • Country; and

  • Other required delivery information.

Please contact Raccoon Roses immediately if you discover an error.

Once an order has entered production or been shipped, we may be unable to modify or cancel it.

9. Shipping

Raccoon Roses may use third-party manufacturers, print-on-demand providers, fulfillment centers and shipping carriers.

Orders containing multiple products may be manufactured or shipped from different locations.

As a result, one order may arrive in multiple packages.

10. Delivery Estimates

Any delivery dates shown during checkout are estimates unless expressly identified as guaranteed.

Delivery times may be affected by circumstances outside our reasonable control, including:

  • Customs processing;

  • Carrier delays;

  • Severe weather;

  • Public holidays;

  • High order volumes;

  • Manufacturing delays;

  • Incorrect addresses;

  • Transportation disruptions; and

  • International events.

We will provide assistance with delivery problems where reasonably possible.

11. Lost Packages

If tracking indicates that a package has been lost or if it has not arrived within a reasonable period, please contact Raccoon Roses Customer Support.

We may need to investigate the shipment with the carrier or fulfillment provider before providing a resolution.

The available resolution will depend on the circumstances and applicable law.

12. Incorrect Delivery Information

Customers are responsible for ensuring their delivery information is accurate.

If a package cannot be delivered because incorrect or incomplete information was provided, additional shipping or replacement costs may apply where legally permitted.

Please contact us as quickly as possible if you notice an address error.

13. Returns & Right to Cancel

Return and cancellation rights vary around the world.

Customers may be entitled to mandatory cancellation or return rights under the laws applicable to them.

For example, consumers within the European Economic Area may generally have statutory withdrawal rights for qualifying distance purchases, subject to exceptions.

Where mandatory local consumer law provides greater rights than these Terms, those mandatory rights will apply.

Customized or clearly personalized products may be excluded from certain change-of-mind return rights where permitted by applicable law.

14. Damaged, Defective or Incorrect Products

If you receive an item that is:

  • Damaged;

  • Defective;

  • Incorrect;

  • Misprinted; or

  • Significantly different from what you ordered,

please contact Raccoon Roses Customer Support as soon as reasonably possible.

Please provide your order number, a description of the issue, and clear photographs where appropriate.

Depending on the circumstances and applicable consumer law, an appropriate solution may include a replacement, repair, refund or another remedy.

15. Refunds

Approved refunds will generally be returned to the original payment method unless another method is agreed or required.

Banks and payment processors may require additional time to process a refund after it has been issued.

Nothing in this policy restricts mandatory refund or consumer protection rights applicable in a customer's jurisdiction.

16. Exchanges

Exchange availability may depend on the product and fulfillment location.

For print-on-demand and made-to-order products, direct exchanges may not always be possible.

Where an exchange cannot be provided, Customer Support will explain the available options.

17. Intellectual Property

Unless otherwise stated, original Raccoon Roses branding, artwork, logos, graphics, designs, photographs and other original content are owned by or licensed to Raccoon Roses.

Raccoon Roses content may not be reproduced, redistributed, modified, commercially exploited or resold without authorization.

18. Third-Party Trademarks

Raccoon Roses is an independent brand.

Unless expressly stated otherwise, Raccoon Roses is not sponsored by, endorsed by, affiliated with, or officially connected to any motorcycle manufacturer, helmet manufacturer, riding-equipment manufacturer, racing organization or other third-party company.

All third-party trademarks, logos and brand names remain the property of their respective owners.

19. Motorcycle & Motocross Merchandise Disclaimer

Raccoon Roses products may feature motorcycle, racing, motocross or street-riding themes.

Unless a product is specifically advertised and certified as protective riding equipment, it should not be considered motorcycle protective equipment.

Standard Raccoon Roses hoodies, jerseys, shirts, gloves, accessories or similar merchandise should not be relied upon to provide crash or impact protection.

Customers should always use appropriate certified motorcycle protective equipment when riding.

20. Product Use

Customers are responsible for using purchased products safely and appropriately.

Raccoon Roses is not responsible for damage caused by intentional misuse, unauthorized modification, improper maintenance, or use contrary to product instructions, except where liability cannot legally be excluded.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Raccoon Roses will not be responsible for indirect or consequential losses arising from circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful.

Mandatory consumer protections remain unaffected.

22. Privacy

Customer personal information will be handled according to the Raccoon Roses Privacy Policy and applicable privacy and data-protection laws.

Information may be shared with service providers where reasonably necessary to:

  • Process payments;

  • Manufacture products;

  • Fulfill orders;

  • Deliver packages;

  • Prevent fraud; and

  • Provide customer support.

23. Fraud & Abuse

Raccoon Roses reserves the right to refuse, suspend or cancel transactions involving suspected fraud, payment abuse or unlawful activity.

We may also refuse service where reasonably necessary to protect customers, our business or our service providers.

24. Changes to These Terms

These Terms may be updated from time to time to reflect changes to our store, services, fulfillment process or applicable legal requirements.

The version applicable to an order will generally be the version in effect when the customer placed that order, subject to applicable law.

25. Governing Law

Raccoon Roses operates from Belgium.

To the extent permitted by applicable law, these Terms are governed by Belgian law.

However, this does not remove mandatory consumer rights or protections that customers may have under the laws applicable in their country or region.
